1.Webdesign Terms and Condition

This agreement constitutes the sole agreement between Dellsa and the Client regarding this Web Design Project. Any additional work not specified in this contract or any other amendment or modification to this contract must be authorized by a written request signed by both Client and Dellsa Trading LTD. The undersigned hereby agree to this terms and conditions on behalf of his or her organization or business. This policy constitutes the entire understanding of the parties. Any changes or modifications thereto must be in writing and signed by both parties.

2. Code of Acceptable Conduct

2.1 Client agree that all messages, pictures, graphics and any other content whatsoever posted or uploaded to the web site are solely the opinion and responsibility of the person posting them.

2.2 Client acknowledges that Dellsa cannot exercise control over postings to the web site and that, therefore, we shall in no way be responsible for any such postings.

2.3 Client agrees that Dellsa shall be entitled upon notice to remove any posting about which any person has made a formal complaint. Re-posting of the posting on the subject of the complaint shall be at our absolute discretion.

2.4 Client agrees that, will not indulge in any of the following categories of conduct when making use of any services offered by us relating to the web site:

2.4.1 Posting material relating to any individual or corporation, which is insulting, derogatory or defamatory in nature;

2.4.2 Posting material, which is obscene, pornographic or adult in nature;

2.4.3 Posting material containing profanity, vulgarity, hate speech, or threats of violence;

2.4.4 Making repetitive postings or performing other actions, which interfere with the operation of the website.

2.4.5 Posting contact or personal information about any other individual without permission;

2.4.6 Posting copyright items without the permission of the copyright owner;

2.4.7 Continuing to send e-mail or postal correspondence to any other user of a web site after being requested to stop doing so by the recipient;

2.4.8 Using any computer code, program or routine to extract or to attempt to extract any substantial part of the database comprising all postings of the web site;

2.4.9 Refusing to follow a reasonable instruction or direction from the site operator.

2.5 Client agrees that conduct falling within the categories listed in 2.4 above shall constitute legitimate grounds for immediate suspension from the web site and/or removal of any offending posting without notice.

3. Third Party Web sites

Dellsa not responsible for nor do we endorse any third party web sites or material, which you access in the course of using the web site. This includes any reliance upon or offence taken /caused by content, advertising, products or services accessed. Interaction between You and any advertisers, service providers or merchants listed on the web site, including payment, delivery, product conditions, warranties, contracts and any other interaction are solely between you and the relevant party. You agree that you do not hold us responsible for any loss damage or dispute in the course of these processes.

4. Statistical Analysis

During Your visits to this web site, site usage may be measured to enable statistical analysis of user behavior. These results may be used to inform advertisers or service providers of potentially attractive locations within the web site. These data will be presented as aggregated results and may be passed on together with User Information. You should also be aware that these data may be automatically collected using ‘cookies’. These small text files are placed on your hard disk via your web browser and record your usage behavior whilst you visit the web site. Dellsa accept no liability for any information contained on the web site.

6. Site Operator Indemnity

DEellsa shall not be liable for any damages, including without limitation, indirect or consequential damages, howsoever arising out of your use of this web site or in respect of any of your actions or omissions taken in reliance on any information contained on this web site or any web site to which this web site is linked.

7. Maintenance and Monitoring

In addition to the hosting requirements outlined in the above section DELLSA will also provide the following services on a monthly basis with a monthly fee.

Backups

  • Database backups will be performed daily and moved to a separate server
  • Server backups will be performed daily and moved to a separate server this will include a complete backup of the entire system using Paragon Drive Backup. This will allow for fast recovery in event of a catastrophic failure.
  • Dellsa take daily snapshot copies of the whole server. And store them on a separate backup server.

Firewall

The website and database will be secured behind a firewall ensuring no unauthorized access the data or site.

Monitoring

  • DELLSA will monitor the server and database to ensure that the site is online.
  • Our servers are being hosted in the HOSTGATOR.

Our guaranteed uptime is 99.99%.

Updates

DELLSA will perform regular updates to the server to ensure that the latest security patches are installed and ensure that the site and software are running efficiently.

Bug fixes and support

DELLSA will provide up to 3 hours per month bug fixing and support.

Payment Card Industry Standards

DELLSA will follow PCI standards to protect cardholder data.
